Terms of Service

1. The Service

Controlly lets you register computers ("machines"), view their screens in real time, and remotely control them from a web browser using a lightweight agent you install on each machine.

2. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for all activity under your account and for keeping your login credentials secure. You sign in through Google; you are responsible for the security of that Google account.

3. Remote Access Consent (Important)

You may only install the agent on, and remotely access, computers that you own or are expressly authorized to control. By pairing a machine you represent and warrant that you have the legal right and all necessary consents to view and control that machine and any data on it.

Using Controlly to access computers without authorization is strictly prohibited and may be a criminal offence. You are solely responsible for ensuring your use complies with all applicable laws and any workplace or third-party policies.

4. Subscriptions, Plans & Billing

Paid plans are billed in advance on a recurring basis (monthly) through our payment processor, Stripe. By subscribing you authorize us and Stripe to charge your payment method for the applicable fees until you cancel.

The Personal plan is provided free of charge. Plan limits (machines, members, concurrent sessions) are enforced as described at checkout and may change with notice.

5. Lifetime Offer

From time to time we may offer a one-time "Lifetime" purchase for a specific plan. A Lifetime purchase grants access to that plan's features for as long as Controlly remains operated by Epicom Systems Ltd., with no recurring subscription fee. "Lifetime" refers to the lifetime of the product and service, not the purchaser, and does not guarantee the service will be offered indefinitely.

Lifetime purchases are subject to the Refund & Cancellation Policy (14-day window).

6. Acceptable Use

Your use of Controlly is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. We may suspend or terminate accounts that violate it.

7. Service Availability

We work to keep Controlly available and reliable but do not guarantee uninterrupted or error-free operation. The service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features at any time.

8. Disclaimers & Limitation of Liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising from your use of Controlly.

Our total aggregate liability for any claim relating to the service will not exceed the greater of (a) the amount you paid to Epicom Systems Ltd. in the 12 months preceding the claim, or (b) CAD $100.

9. Termination

You may stop using Controlly and cancel your subscription at any time. We may suspend or terminate your access for violation of these Terms or the Acceptable Use Policy. On termination, your right to use the service ends; provisions that by their nature should survive will survive.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms with a new effective date. Continued use after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Alberta.
